Your privacy is very important to us. This privacy policy addresses how Protect Your Tail Corporation (d/b/a PYT) ("PYT", “We”) collects, protects and uses information you provide. By visiting www.protectyourtail.com (this "Site"), accessing any mobile applications we may provide, using any products or services we may offer from time to time via our Site and/or related applications or otherwise interacting with us (collectively, the “Services”), you agree to accept the practices described in this Privacy Policy.

 

Information We Collect From You Directly 

 

We group the collection of user information into two categories: personal, which is information identifiable to a specific individual, and aggregate, which is collective information about a group of individuals that does not identify any individual person. Personal information may include your name, email address, mailing address, or phone number. Examples of aggregate information are the number of visitors to our Site, statistics on customer demographics and shopping trends. PYT may use or disclose aggregate information for any lawful purpose.

We collect information that you provide directly to us. For example, we collect information when you use our Site, shop in our stores, contact our customer service representatives, create an account, sign up to receive emails, sign up to receive text messages, upload or share images or videos of yourself or others on our Site or social media, participate in a sweepstakes or survey, communicate with us via third-party social media sites such as Facebook, Instagram, TikTok or Twitter, or otherwise communicate with us through other interactions.

The types of information you may provide directly to us include, but are not limited to, your name, email, zip code, date of birth, phone number, shipping address, billing address, credit card or payment information, product and size preferences, measurement information, including height, weight and body measurements that could be deemed to be biometric information in certain states, Site preferences, demographic information such as size and language preferences, age, gender, geographical location, time zone, income and education, user generated images or videos, social media profile picture, social media handle, username, product reviews, and any other information you may choose to provide. Providing this information to us is voluntary, however, certain information such as your name, email, phone number, shipping address, billing address, and payment information may be necessary to access or utilize our Services. If you do not provide us with this information, we may not be able to provide you with full access to our Services.

We also collect information when you communicate with us through our customer service channels, such as by phone, live chat, Facebook Messenger and third-party customer review platforms. In compliance with applicable law, we record, monitor and store telephone calls and live chat transcripts when you contact us through our customer service channels. Please note we use chatbots/virtual assistants to assist with common customer service requests and questions when you initiate and interact with the live chat feature available on our Site. By using live chat, you agree to the practices described in this Privacy Policy. You may end your live chat session at any time by closing the chat window.

In some cases, we may also collect information that you provide about others, such as when you purchase a gift card for else and choose to deliver it electronically, ship products to someone else’s mailing address or refer a friend to create an account on PYT. PYT will only use this information to fulfill your requests and will not send any marketing communications unless they choose to register for an account or opt-in to receive communications from us.

 

Information We Collect Automatically

 

Like most online businesses, PYT and its partners and third party service providers collect certain information automatically when you visit or interact with our Site and Services in order to improve the overall quality of your online experience. This information we automatically collect can be personal or aggregate, and includes:
 

  • Log Information: We collect information about your use of our Site, including your internet protocol (IP) address, operating system, the type of browser you use to access the Site, your device’s regional and language settings, browser ID, the referring link through which you accessed our Site, date/time of Site visits, the time you spent on our Site and any errors that may have occurred during your visit.

  • Cookies: Our Site, online advertisements and emails may use first-party and third-party cookies, pixel tags, session replay (on a random sample of Site visitors if used) and other technologies to automatically collect information about you such as your usage and activity on our Site. This activity may include the number of visits to our Site, pages viewed, amount of time spent on a page, links and products clicked, products added to the shopping cart, products purchased, searches made, and any other actions you take in connection with our Site, online advertisements or emails.   • Information from Third Party Sources: We also receive information about you from other sources, including through service providers, third-party information providers, marketing partners, customers, public sources, transactions such as mergers and acquisitions, and through your interactions with us on social media websites and online advertisements. We may combine this information with other information we collect from or about you and add it to the information we associate with your account. Children

 

Our Website is not intended for children under 18, as defined under applicable law. Children may not provide any information to or on the Website. We do not knowingly collect personal information from children. If we learn we have collected or received personal information from a child, we will delete that information. How We Use Your Information

 

We collect personal information to make our Services more rewarding for you to use, including billing, shipping and tracking your orders. How Is This Information Shared

 

There are certain circumstances in which we may share your personal information with certain third parties without further notice to you, as set forth below:
 

  • We do not sell any of your personal information to third parties for profit. Like most online businesses, we do share some information with contracted third parties in order to provide better services and advertising to you, and do afford you the option to opt-out of sharing this information.

  • We may share information about you with trusted third parties in order to improve your consumer experience. These third parties may contact you about products, services or promotions you may be interested in, or to otherwise improve your customer experience with this Site.

  • We may share information about you, such as your name, address, email address, as well as a record of any transactions you conduct on our website or offline with us via our third-party advertising partners and its service providers, in order to deliver to you banner advertisements and other advertising tailored to your interests when you visit certain websites. Our advertising partners will make the data we provide to it anonymous.   • We use session replay technology from time to time, and if used, on a random sampling of Site visitors to automatically collect and analyze information about how visitors interact with our Services using trusted third party service providers who have executed appropriate data processing agreements and have committed to uphold and comply with applicable privacy and security regulations. If you are a part of this random sample of Site visitors, we may share this information about you with our service providers, such as when you visit the Site, how you use the Site, what webpages you visit, time spent on a webpage, what you click on, the links and products viewed and clicked on, what browser you are using when you access the Site, products added to your cart or purchased, and searches made on the Site. We use this information for quality assurance, to monitor and improve customer service support and our Services, and to better understand our customers and other visitors who access our Site to help us develop more relevant products and services. Please note PYT does not collect any personal information through session replay technology, and any information that is collected is not connected to your customer account if you have an account with us.

  • As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, your information may be part of the transferred assets.

  • When we believe in good faith that disclosure is necessary to protect the rights, property and safety of PYT, its users or the public.

  • As required by law, to comply with a judicial proceeding or court order, to exercise our rights, or to defend against any claims.

Cookies and Web Beacons

 

Like most websites, this Site uses cookies, web beacons and other similar technologies to gather user, browser and device information in order to help us better understand user behavior, tell us which parts of this Site users have visited, and facilitate and measure the effectiveness of our Services, advertisements and web searches, and to personalize your experience with our Services. Such information may be collected by or shared with trusted third-party service providers who have committed to uphold and comply with applicable privacy and security regulations. Web Beacon

 

Web beacons, or clear gifs, are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user's computer hard drive, web beacons are embedded invisibly on web pages. Web beacons help us better manage content on our Site by informing us what content is effective. We do not tie the information gathered by web beacons to your personal information.

 

Opting Out

 

We may occasionally send you newsletters and emails regarding announcements, special offers, promotions, features and/or product updates. Please note that when you opt-out of receiving interest-based advertisements, this does not mean you will no longer see online advertisements from us, only that those online advertisements will not be based on your interests. In addition, cookies used on the Site may still collect information for other purposes, including for analytics and fraud prevention.

 

SMS Messaging

 

PYT collects various information from and about you when you sign up to receive automated marketing text messages, including information you directly provide when you enroll in its text message marketing program (the “Messaging Service”). For example, we collect the phone number and email address you provided when signing up for the Messaging Service. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages.

We may also collect information about you using cookies or similar technologies. Cookies enable personalization of your experience on the Messaging Service (e.g., sending you personalized text messages such as shopping cart reminders).
 

If you participate in a contest, sweepstakes, research study, or email survey associated with the Messaging Service, we will collect basic contact information and any other information you choose to provide in connection with these activities. We will also collect your contact information if you contact us with questions about the Messaging Service or for customer service.

We may share, transfer, or disclose your information, if you consent to us doing so, as well as in the following circumstances:

  • Service Providers. We may share your information with third parties to help us provide the Messaging Service to you. For the purposes of the Messaging Service, Attentive acts as our service provider and data processor of your information.

From time to time, we may share aggregate or de-identified information about use of the Messaging Service and such aggregated or de-identified information may be shared with any third party, including advertisers, promotional partners, and sponsors.

We retain your information for as long as you participate in the Messaging Service or as needed to comply with applicable legal obligations. We will also retain and use your information as necessary to resolve disputes, protect us and our customers, and enforce our agreements.

Consent to receive automated marketing text messages is not a condition of any purchase. You can opt-out of receiving further commercial text messages via the Messaging Service by responding to any of our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. This Privacy Policy shall not apply to any unsolicited information you provide to PYT through this Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, such as review sections and forums (collectively, "Public Areas"), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, "Unsolicited Information"). All Unsolicited Information shall be deemed to be non-confidential and PYT shall be free to reproduce, use, disclose, distribute and exploit such Unsolicited Information without limitation or attribution.

  • Right to Access/Portability. You have the right to request and receive a copy of your personal information we have collected, used, disclosed, sold and shared within the previous 12 months. You can also view and manage most of your personal information by logging into your account.

  • Right to Deletion. You have the right to request the deletion of your personal information we collect and maintain. Please be aware that deleting your personal information is irreversible and means that you will no longer have an account with us. By submitting a deletion request, you will be deleting your entire account including any member credits, reward points, and order history. If you have any member credits on your account, those credits will be deleted and can no longer be used. If you chose to use our Site at a later time, you will need to sign up again and create a new account. 

  • Right to Opt-Out of Sale or Sharing of Personal Information. You have the right to opt-out of the sale of your personal information. PLEASE NOTE, WE DO NOT SELL ANY OF YOUR PERSONAL INFORMATION TO THIRD PARTIES FOR PROFIT. LIKE MOST ONLINE BUSINESSES, WE DO SHARE SOME INFORMATION WITH CONTRACTED THIRD PARTIES IN ORDER TO PROVIDE BETTER SERVICES AND ADVERTISING TO YOU. California law may classify our limited sharing with these contracted third parties as a “sale” or "sharing" of personal information, and we do afford you the option to opt-out of sharing this information. You can opt-out by submitting a request through our online webform located here or by contacting our customer services representatives via email at support@protectyourtail.com 7 days a week or by calling (903) 962-2259 at any time.
     

  • You may also opt-out of the sale or sharing of your personal information by enabling an Opt-Out Preference Signal, such as the Global Privacy Control (“GPC”), available in certain browsers and extensions. We will treat the GPC browser signal as a valid opt-out request. If you do not have a PYT account or if you are not logged into your PYT account, your request to opt-out via the Global Privacy Control will be linked to your browser identifier only and not linked to any account because your connection between your browser and your account is not known to us. If you would like us to make the connection between your browser and your account, please sign-in to your account and enable the Global Privacy Control. You may need to take this step to opt-out on additional browsers and devices that you use. If you block or clear cookies from your browser, it may remove the Global Privacy Control settings, requiring you to opt-out again.

    Please be aware that even after submitted an Opt-Out request, you may still continue to see advertisements regarding our company online or through third parties. If you continue to visit or use the Site, you may also come across our ads. You will no longer receive personalized advertisements, but you may still see generic, non-personalized advertisements such as those based on the topic and content of a webpage that you visit.

  • Right to No Retaliation/Non-Discrimination. You have the right to exercise any of your Privacy Rights free from discriminatory practices prohibited by California law. For example, unless permitted under CPRA, we will not deny you goods or services, charge you a different price or rate for goods or services, provide you with or suggest that you will receive a different level or quality of goods or services if you make an access, deletion, opt-out or limitation of use/disclosure request. Some of our products and Services, however, may require your personal information. If you choose not to provide your personal information that is necessary for any aspect of our products or Services, you may not be able to use those products or Services.

  • Effective January 1, 2023: Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to request that your sensitive personal information only be used for certain business purposes that are necessary for us to perform our services or provide our products to you. Those business purposes are: (i) to ensure the security and integrity of our systems and networks; (ii) to provide non-personalized advertising as a part of your current interaction with our business; (iii) to perform our Services to you, including, but not limited to, maintaining or servicing your account, providing customer service, processing or fulfilling orders, verifying customer information, processing payments, providing analytics services, storing customer information, or providing similar business services; and (iv) to verify and maintain the quality and safety of our Services and to improve, upgrade or enhance our Services to you. Please be aware that we do not use any sensitive personal information for any purposes other than those that are permitted under the law and specified under this section.

  • Effective January 1, 2023: Right to Correct Inaccurate Personal Information. You have the right to correct inaccurate personal information that we maintain about you. You can also view and manage most of your personal information by logging into your account.

 

How To Exercise Your Privacy Rights

Prior to processing, we will authenticate your request through our standard verification procedures, such as by requesting you to log in to your account or by verifying the information you provided in your request with your account information we have on file. This information may include first name, last name, email and phone number. Please be aware that this information will only be used to verify and help process your request. However, we are required by law to keep information related to your request for record keeping purposes. 

Please allow up to 15-65 days for us to complete your request. Please note, these Privacy Rights are subject to exceptions, and in certain cases we may decline your request as permitted by law. For example, if you have placed an order or initiated a return or exchange within the last 90 days prior to submitting a deletion request, we will process your deletion request once the 90 days have passed so that we may fulfill your order and uphold our return and exchange obligations to you.
